Terms of Service

1. Acceptance of Terms
By creating a TowMarX account or using any TowMarX services, you agree to be bound by these Terms of Service. If you are using TowMarX on behalf of a company or organization, you represent that you have authority to bind that entity to these terms.
2. Description of Service
TowMarX provides a roadside assistance dispatch and network management platform. We facilitate connections between dispatchers (dealerships, fleets, motor clubs) and service tenants (tow companies, roadside operators). TowMarX is a platform — we do not provide roadside assistance services directly.
3. Account Types
Dispatcher accounts create and dispatch jobs and may create networks. Tenant accounts receive and fulfill dispatched jobs. Each account type has different features, pricing, and responsibilities as described on our Pricing page.
4. Pricing and Payment
Free accounts have no associated fees. Paid accounts are billed monthly or annually as selected. Platform fees ($3 per dispatched job on all plans) are calculated and billed at the end of each billing cycle. All prices are in USD. We reserve the right to change pricing with 30 days notice.
5. Network Marketplace
Network owners are responsible for managing their networks, including approving members, setting payout rates, and resolving disputes between network members. TowMarX provides the infrastructure but does not mediate disputes between network participants.
6. User Conduct
You agree to provide accurate information, maintain the security of your account, comply with all applicable laws, and not misuse the platform. Dispatchers must ensure jobs are legitimate. Tenants must maintain proper licensing, insurance, and equipment for the services they offer.
7. Photo and Data Requirements
Tenants are required to submit photos at pickup and drop-off for job verification. GPS location data is collected during active jobs. By using the platform, you consent to this data collection as described in our Privacy Policy.
8. Limitation of Liability
TowMarX is a platform that connects dispatchers and tenants. We are not responsible for the quality of roadside services, vehicle damage during towing, disputes between parties, or any losses arising from the use of tenant services arranged through our platform.
9. Termination
You may close your account at any time. We may suspend or terminate accounts that violate these terms. Upon termination, your data will be retained for 12 months per our data retention policy, after which it will be deleted.
10. Changes to Terms
We may update these terms from time to time. We will notify you of material changes via email or in-platform notification at least 30 days before they take effect. Continued use of TowMarX after changes constitutes acceptance.
11. Governing Law
These terms are governed by the laws of the State of Texas. Any disputes shall be resolved in the courts of Dallas County, Texas.
